An upset customer at My Hero Sub & Pub in Phelan, pulled out a firearm, and aimed it at those inside the business before fleeing the scene on February 17th, 2025.

A 61-year-old Phelan man was arrested Monday night after allegedly pointing a firearm at employees and customers at My Hero Subs following a dispute over being denied alcohol service, authorities said.

Deputies responded to a 911 call at 7:49 p.m. on February 17 at My Hero Subs in Phelan. Witnesses reported that a man, later identified as Richard Kelley, attempted to order a beer but was informed that alcohol sales had ended for the night. Kelley then allegedly became upset, pulled out a firearm, and aimed it at those inside the business before fleeing the scene, according to the San Bernardino County Sheriff’s Department.

Sheriff deputies were able to contact Kelley by phone, and he agreed to meet deputies at the Phelan Sheriff’s Station, where he was arrested without incident. He was booked at the High Desert Detention Center on charges of assault with a firearm and exhibiting a weapon in a public place. He was later released on bail.

The investigation remains ongoing. Authorities are asking anyone with information to contact Deputy A. El Kabany at the Victor Valley Sheriff’s Station at (760) 552-6800.
